Thomas Bell of Gatehouse Chambers analyses a recent Court of Appeal decision which confirms that ‘pay first’ clauses in marine insurance policies remain enforceable despite an insured’s insolvency, with the Court rejecting arguments based on inconsistency, hierarchy clauses and the so-called onerous clause doctrine.
