Frances Coulson and Sarah May of Wedlake Bell recap a recent case considering the bankruptcy “use it or lose it” provision, which gives a trustee three years to decide what, if anything, to do about an interest in a property which is the home of the bankrupt, barring which the property ceases to form part of the bankrupt’s estate and revests in the bankrupt.
