Towards a New Approach for the Choice of Insolvency Forum

Anthony Casey of the University of Chicago Law School, Aurelio Gurrea-Martinez of Singapore Management University and Robert Rasmussen of USC Gould School of Law urge UNCITRAL to abolish the concept of COMI and replace it with an ex ante approach which allows debtors to choose the insolvency forum in the company’s constitution.
