Ross Baker and Andrew Layton-Morris of Beale & Co examine a recent BVI law decision in which the High Court applied UK authorities to examine a director's potential fiduciary duties in the post-liquidation period, concluding that the existence of such duties is not an "all or nothing question", and whether such duties exist will depend heavily upon the facts of the case and the relationship between the relevant parties.
